These Terms govern the use of REALM services in the Republic of Fiji.

1. Services

REALM provides marketplace and agency services for:

Agricultural machinery and equipment
Livestock
Rural property
Produce and agricultural goods
Auctions and negotiated sales
Marketing and finance facilitation

REALM generally acts as an intermediary between vendors and purchasers.

2. Registration

To participate in auctions or transactions you must:

Provide accurate information
Be legally capable of entering a binding contract
Maintain account security

REALM may conduct identity or eligibility checks where required.

3. Bidding and Purchases

A bid constitutes a binding offer to purchase. Winning bidders must complete the transaction according to the sale terms. Failure to do so may result in penalties, suspension, or recovery of losses.

4. Vendor Obligations

Vendors warrant that:

They have authority to sell the item
Listings are accurate and not misleading
Goods are lawful to sell
Material defects are disclosed

Misrepresentation may result in cancellation of sale and liability for losses.

5. REALM as Agent

REALM typically acts as an agent or platform provider. Contracts are formed between Vendor and Purchaser unless stated otherwise. REALM is not responsible for the quality, safety or suitability of goods except where required by law.

6. Fees

Applicable fees may include:

Listing fees
Commission
Buyer’s premium
Marketing costs
Platform fees

Fees will be disclosed prior to engagement.

7. Payments

Payments must be made within specified timeframes using approved methods. Failure to pay may result in cancellation and recovery action.

8. Delivery and Risk

Unless otherwise agreed:

Purchasers are responsible for collection and transport
Risk transfers according to the sale terms
Storage fees may apply

9. Consumer Protection

Nothing in these Terms excludes rights under applicable consumer protection laws in Fiji.

10. Fair Trading

All parties must comply with laws prohibiting misleading or deceptive conduct.

11. Limitation of Liability

To the maximum extent permitted by law, REALM is not liable for indirect or consequential loss. Nothing in these Terms limits rights that cannot legally be excluded.
